GENERAL PROVISIONS

These general online sales conditions are valid exclusively between Pinin Diffusion s.r.l., Corso Matteotti 8/A LECCO – 23900 – (LC), VAT ID 03680230137, and any person making purchases online on the website sentakuscissors.com, hereinafter referred to as the "customer."

These conditions may be subject to changes, and the date of their publication on the website corresponds to the date they come into effect.

These conditions govern the purchases made on the aforementioned website in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, amended by Legislative Decree no. 21/2014, and Legislative Decree 70/2003 on electronic commerce.

OBJECT OF THE CONTRACT

Under these sales conditions, Pinin Diffusion s.r.l. sells and the customer remotely purchases the tangible movable goods indicated and offered for sale on www.pinin.com.

The contract is concluded exclusively through the internet, by accessing the customer at sentakuscissors.com, at the “Shop” section, and making a purchase order according to the procedure provided by the site.

The customer undertakes to view these general sales conditions and to accept them by ticking the box provided before proceeding to confirm their order.

PRE-CONTRACTUAL INFORMATION (Art. 49 Legislative Decree 206/2005)

Before concluding the purchase contract, upon selecting the product, the customer is informed about the main features of the good, which are illustrated on the individual product sheets in the “Shop” section.

Before order validation, the customer is informed about:

The total price of the goods, inclusive of VAT, shipping costs, and any other expenses;

Payment methods;

Delivery timeframe;

Conditions, terms, and procedures for exercising the right of withdrawal;

Existence of a legal warranty of conformity for the purchased goods;

Information about Pinin Diffusion srl, including geographical address, telephone number, and email address.

PRODUCTS AND PRICES

Pinin Diffusion s.r.l. commits to describing and presenting the items sold on the sentakuscissors.com website as best as possible. However, some errors, inaccuracies, or small differences between the website and the actual product might occur.

The photographs of the products presented do not constitute a contractual element, as they are only representative.

The prices of the products are expressed in euros and include VAT.

Shipping costs are stated separately and summarized, both with and without VAT, in the cart – before the conclusion of the purchasing process – and on the invoice.

Any promotional codes that provide discounts on the base price must be entered in the designated area before proceeding with payment confirmation.

The customer accepts that Pinin Diffusion s.r.l. may change its prices at any time, but the goods will be invoiced based on the prices listed on the site at the time the order is made.

Should there be an error of any kind that could result in a substantial change – not foreseen by Pinin Diffusion s.r.l. – in the sale price, Pinin Diffusion s.r.l. will put the customer in the condition to either reconfirm the purchase of the products at the correct price or cancel it.

CONCLUSION AND EFFECTIVENESS OF THE CONTRACT

The sale contract is considered concluded with the sending by Pinin Diffusion s.r.l. to the customer of an email confirming the order. The email contains the customer's details and the order number, the price of the goods purchased, shipping costs, and the delivery address to which the goods will be sent, and the link to print and store a copy of these conditions.

The customer commits to verifying the accuracy of the personal data contained in the above email and to communicate any corrections/modifications to Pinin Diffusion s.r.l.

The order confirmation sent is, however, always subject to the condition subsequent of total impossibility of delivery. In such an event, the customer will be promptly informed by email, and the payment, if already made, will be refunded in full. If payment has not yet occurred, the customer will be released from the obligation to pay.

PRODUCT AVAILABILITY

The availability of products refers to the actual availability at the time the customer places the order. This availability must be considered purely indicative because:

Due to the simultaneous presence of multiple users on the site, products could be sold to other customers before the order is confirmed;

A computer anomaly could make a product available for purchase that is in reality out of stock.

Even following the order confirmation email sent by Pinin Diffusion s.r.l., cases of partial or total unavailability of the goods may occur. In this event, the order will be automatically adjusted by eliminating the product or products that are unavailable, and the customer will be immediately informed via email; with this email, the customer will also be informed of the methods and timing of the refund of any sums paid.

PAYMENT METHODS AND BILLING

Payments must be made in euros.

Each payment by the customer can only occur through the PayPal circuit, via PayPal account, or with the following credit cards: MasterCard, Maestro, Visa, Visa Electron, American Express, Aura, Discover.

In case of credit card payment, the actual charge of the order amount will only take place when the order is complete and ready for shipment.

In case of payment with PayPal, the actual charge will take place at the time of sending by Pinin Diffusion s.r.l. of the order confirmation email.

No credit card data is stored in the databases of Pinin Diffusion s.r.l..

Following the payment, a receipt for each order made will be issued; this receipt can be used as a document attesting to the validity of the warranty under the terms and conditions provided at the point “Warranty.”

The customer has the option, during the order confirmation phase, to replace the aforementioned receipt with an invoice, for the issuance of which the information provided by the customer during the purchasing process will be taken as valid.

Once the invoice has been issued, it will not be possible to make any changes to the data indicated therein.

The customer may indicate a billing address different from the shipping address.

DELIVERY METHODS

Pinin Diffusion s.r.l. will only accept orders to be delivered in the Italian territory, including the islands.

The cost of shipping is €10.00, excluding VAT.

The products purchased will be delivered via courier to the address indicated by the customer at the time of the order within and no later than 30 days from the date the customer receives the order confirmation email sent by Pinin Diffusion s.r.l..

The delivery times for customized products and/or those to be made from scratch, if not available for immediate delivery within the aforementioned 30 days, will be indicated by Pinin Diffusion s.r.l. to the customer via email.

Pinin Diffusion s.r.l. assumes no responsibility in case of communication of incorrect or incomplete addresses.

In any case, Pinin Diffusion s.r.l. is totally relieved of any responsibility for the custody of the goods for the portion managed by third parties (postal service or couriers).

Delivery will take place during office hours on working days.

Upon delivery of the product, the customer must verify that the package is perfectly closed and sealed.

If the delivered package is not intact, damaged, or the adhesive tape appears tampered with, the customer is invited to immediately report it to the courier and not proceed with the collection; otherwise, the product will be considered regularly delivered, and Pinin Diffusion s.r.l. will be relieved of responsibility for any damage and/or in case of lack of the product.

RIGHT OF WITHDRAWAL

The customer, in accordance with the legal provisions in force (art. 52 Consumer Code), has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days from the date of receipt of the products.

The customer who intends to exercise the right of withdrawal must communicate it to Pinin Diffusion s.r.l. through an explicit statement that can be sent by registered mail to the following address:

In this case, the return of the products is carried out at the expense and risk of the customer within 14 days from the day on which he communicated to Pinin Diffusion s.r.l. his intention to withdraw from the contract, pursuant to art. 57 of Legislative Decree 206/2005.

The goods must be returned intact, in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment) and complete with the attached tax documentation.

Subject to the right to verify compliance with the above, Pinin Diffusion s.r.l. will refund the amount of the products subject to withdrawal within a maximum period of 30 days from receipt of the goods.

It is understood that the goods returned beyond the aforementioned terms or lacking the required requirements will not be refunded by Pinin Diffusion s.r.l..

As provided by art. 56 co. 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, Pinin Diffusion s.r.l. may suspend the refund until receipt of the goods or until the customer has demonstrated that the goods have been sent back to Pinin Diffusion s.r.l.

Pinin Diffusion s.r.l. will carry out the refund using one of the following methods that must be previously chosen by the customer in the letter of withdrawal:

Issuance of a purchase voucher valid for one year;

Re-credit of the amount already paid using the bank details that must be provided by the customer (IBAN and beneficiary).

The right of withdrawal cannot be applied in the case of products customized at the express request of the customer at the time of placing the order.

LEGAL WARRANTY OF CONFORMITY

To the customer who has entered into the contract as a "consumer" (this term being defined as any natural person who acts on the site for purposes unrelated to any business or professional activity), Pinin Diffusion s.r.l. guarantees the conformity of the product for a period of 2 years from the date of delivery.

To the customer who has entered into the contract as a "professional", Pinin Diffusion s.r.l. guarantees the conformity of the product for a period of one year from the date of delivery.

In the event of receipt of defective products or otherwise not conforming to the orders placed, the customer has the right, without expenses, to the restoration of the product's conformity if the defect manifests itself within the aforementioned terms and is reported within two months from its discovery.

The legal warranty will not apply if the reported defect and/or defect is due to the customer's fault, negligence or malice, or to causes attributable to the customer and in any case not attributable to Pinin Diffusion s.r.l., including, by way of example and not exhaustively, poor or improper use of the product.

LIABILITY

Pinin Diffusion s.r.l. assumes no responsibility for disservices attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disservices of the internet network, in the event that it fails to execute the order within the times provided by the contract.

ACCESS TO THE SITE

The customer has the right to access the site for consultation and making purchases. No other use, especially commercial, of the site or its content is allowed.

The integrity of the elements of this site, whether sound or visual, and the technology used remain the property of Pinin Diffusion s.r.l. and are protected by intellectual property rights.

COOKIES

The website sentakuscissors.com uses "cookies". Cookies are electronic files that record information relating to the customer's navigation on the site (pages viewed, date and time of consultation, etc...) and that allow Pinin Diffusion s.r.l. to offer a personalized service to its customers.

Pinin Diffusion s.r.l. informs the customer of the possibility of disabling the creation of such files by accessing their internet configuration menu. It is understood that this will prevent the customer from proceeding with online purchases.

INTEGRALITY

These General Conditions of Sale consist of all the clauses that compose them. If one or more provisions of these General Conditions of Sale are considered invalid or declared as such under the law, regulation or following a decision by a court having jurisdiction, the other provisions will continue to have full force and effect.

APPLICABLE LAW AND COMPETENT COURT

These General Conditions of Sale are subject to Italian law.

Any dispute that does not find an amicable solution will be subject to the exclusive jurisdiction of the Court of Lecco, except in the case where the customer is a consumer.

In the latter case, any dispute will be subject to the exclusive jurisdiction of the Court of the place of residence or domicile of the customer, if located in the territory of the State.
